The US Citizenship and Immigration Services (USCIS) clarified that a sole proprietorship is not eligible to file a petition for an L1 foreign worker’s visa. The USCIS stated that a sole proprietorship does not exist as a separate legal entity from its owner. However, the policy does distinguish a sole proprietor from a self-incorporated petitioner, such as a corporation or a limited liability company with a single owner, which can file a petition. The USCIS also updated its policy regarding blanket petitions, stating that the failure to timely file an extension does not trigger a waiting period.
