The Supreme Court questioned why Section 6A of the Citizenship Act, which protects and grants citizenship to migrants in Assam, does not cover migrants in West Bengal. The court asked why Assam was singled out when West Bengal has a longer border and also faces the issue of influx. The solicitor general argued that the law’s applicability is based on territory and cannot be declared unconstitutional. The court sought a response from the West Bengal government, but no one appeared.
