Merely liking obscene social media post not an offence: Allahabad HC

By on October 28, 2023 0 19 Views

The Allahabad High Court has ruled that liking an obscene post on social media does not constitute an offense, but sharing or retweeting such content will be considered “transmission” and may attract penalties. The court quashed criminal proceedings against a petitioner who had liked another person’s post, stating that liking a post does not amount to publishing or transmitting it. The court clarified that Section 67 of the Information Technology Act applies specifically to obscene material, not provocative material.
